Who these terms are between

These terms are an agreement between you and Budget Bird Limited, a New Zealand company. They apply when you create a Budget Bird account or run a class with it. If you're agreeing on behalf of a school, you're confirming you're allowed to do that.

What Budget Bird is

Budget Bird is a classroom activity for exploring how a government budget works. Running classes is free, with no cap on how many. Some things — full class reports, and the school plan — are paid, and are priced on the Plans page.

It's an educational tool. The figures come from published New Zealand Budget data, and the outcomes students see are a simplified model, not a forecast or advice about real fiscal policy.

Your account

• Keep your login details to yourself. You're responsible for what's done through your account.
• Give us accurate details, and keep your email address current so we can reach you about your account.
• Accounts are for teachers and school staff. Don't create one for a student.

Running a class

Students join with a class code and a team name. They don't create accounts and we don't ask them for personal details — see the Privacy Policy for exactly what's stored.

The team name and the reflection answers are free text, so please ask your students not to put personal information in them. You control the class and can delete it, and everything in it, from your dashboard.

You agree not to use Budget Bird to:

• collect personal information about students through the free-text fields;
• break the law, or infringe someone else's rights;
• attempt to disrupt the service, or access parts of it you're not entitled to;
• resell or rebrand it as your own product.

Paying for things

Payments are processed by Stripe. Prices shown include GST. A subscription renews until you cancel it, and you can cancel any time from your settings — you keep access until the end of the period you've paid for.

School invoices are issued annually and due on the terms shown on the invoice. If something goes wrong with a purchase, email harry@budgetbird.co.nz and we'll sort it out.

Your content and ours

Class names, reflection questions and the results your classes produce stay yours. You give us permission to store and process them so we can provide the service to you — nothing more.

Budget Bird itself — the software, the design, the written material — stays ours. You're welcome to use the lesson materials in your own classroom.

Availability

We work to keep Budget Bird running, but we can't promise it will never be unavailable. We may change or retire features. If a change materially reduces something you're paying for, we'll tell account holders by email.

Liability

Nothing here limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that can't be contracted out of. Where a school or business is using Budget Bird for business purposes, those Acts are contracted out of to the extent the law allows.

Beyond that, our total liability for any claim is limited to what you've paid us in the twelve months before the claim, and we're not liable for indirect or consequential loss.

Ending things

You can stop using Budget Bird and ask us to delete your account at any time. We may suspend an account that breaches these terms, and we'll tell you why if we do.

Changes and law

If we change these terms in a way that matters, we'll update the date at the top and tell account holders by email. These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.
